1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the website operated by The Oriel Studio (“we”, “us”, “our”) and all purchases made through it.

By accessing this website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, together with our:

· Shipping Policy

· Privacy Policy

If you do not agree, you must not use this website or place an order.

2. Eligibility

By using this website, you confirm that:

· You are at least 18 years old;

· You are legally capable of entering into binding contracts;

· All information provided by you is accurate and complete.

3. Made-to-Order Products

All products sold by The Oriel Studio - are manufactured following confirmation of purchase.

Production begins upon order acceptance and clearance of payment.

Once production has commenced:

  • Orders cannot be cancelled;
  • No refunds are available for change of mind;
  • Cooling-off rights do not apply to made-to-order goods under UK Consumer Contracts Regulations.

You expressly acknowledge that you are purchasing goods manufactured specifically for your order.

4. Orders & Acceptance

When you place an order through our website, you are responsible for checking the product specification, dimensions, colour, glazing options, delivery details and price before submitting the order.

We reserve the right to decline or cancel an order where there has been a genuine and obvious pricing, product specification, delivery charge, software, system or technical error.

Where such an error is identified before manufacture has commenced, we will contact you as soon as reasonably practicable.

We will not require you to proceed at a corrected price without your agreement. Where the order cannot be fulfilled on the terms shown because of a genuine error, we may offer you the option to proceed on corrected terms or cancel the affected order and receive a refund of payments received.

5. Pricing & Payment

All prices are displayed in GBP (£). VAT will be charged where applicable.

The price displayed for a product relates to the selected product and specification.

Before placing an order, customers should review the order summary, including any applicable product, VAT and delivery charges.

Where delivery costs depend upon location, product dimensions, weight or specialist transportation requirements, the applicable delivery cost or method by which it will be calculated will be communicated.

You confirm that:

  • You are authorised to use the payment method provided; and
  • All billing and payment information supplied is accurate.

6. Delivery Charges & Collection

Due to the size, weight and specialist nature of architectural glazing products, delivery charges vary according to factors including:

  • Delivery postcode
  • Distance
  • Product dimensions
  • Product weight
  • Specialist transportation requirements
  • Access requirements

Delivery is not included within the displayed product price.

Where delivery is purchased, delivery is normally kerbside delivery only unless otherwise agreed in writing.

Kerbside delivery does not include installation, positioning of the product within the property, specialist lifting equipment or additional handling services.

Customers may alternatively arrange collection from our Watford facility without a delivery charge, subject to prior arrangement.

If a delivery charge is incorrectly displayed, omitted or shown as £0.00/free shipping because of a genuine technical, software or configuration error, please refer to Section 4 above. We will contact you as soon as reasonably practicable if such an error is identified.

7. Measurements & Customer Responsibility

For Supply Only orders, the customer is responsible for:

  • Accuracy of measurements supplied;
  • Checking and approving final dimensions;
  • Structural suitability of the property;
  • Obtaining any necessary planning permission or regulatory approval;
  • Compliance with applicable building regulations;
  • Ensuring adequate structural support.

The Oriel Studio shall not be liable for:

· Incorrect measurements provided by the customer;

· Structural incompatibility;

· Inadequate support or load-bearing capacity;

· Property movement or subsidence;

· Pre-existing structural defects.

No refund, repair, or replacement shall be provided where issues arise from inaccurate information supplied by the customer.

8. Installation

Where installation has been purchased, the customer is responsible for:

  • Structural suitability of the property;
  • Obtaining any necessary planning permission or regulatory approval;
  • Compliance with applicable building regulations;
  • Ensuring adequate structural support;
  • Safe and reasonable site access must be provided;
  • The opening and surrounding structure must be appropriately prepared;
  • Site conditions must comply with requirements communicated before installation.
  • The site must be structurally prepared and compliant with safety standards.

We shall not be liable for:

· Hidden structural defects;

· Damage to finishes, plaster, render, or decoration;

· Pre-existing site conditions;

· Delays caused by site unpreparedness.

Additional reasonable charges may apply where an installation cannot proceed because the site is not ready, access is unavailable or agreed preparatory works have not been completed.

Where installation is carried out by third parties, we accept no liability for:

· Improper installation;

· Sealant failure;

· Glass breakage during fitting;

· Structural damage caused by installers.

9. Product Tolerances & Variations

Due to the nature of glazing and structural fabrication:

· Minor dimensional tolerances apply;

· Visual variations may occur;

· Natural expansion and contraction may occur;

· Differences in screen colour representation may occur.

Such variations do not constitute defects.

10. Delivery & Risk

Customers are responsible for ensuring that:

  • The delivery address is accurate;
  • Suitable access is available;
  • Any unloading requirements communicated in advance have been arranged.

For consumer orders, risk in the goods passes in accordance with applicable consumer law, normally when the goods come into the physical possession of the customer or a person identified by the customer to receive them.

Following delivery, the customer is responsible for appropriately storing and protecting the goods prior to installation.

Where delivery fails because of circumstances attributable to the customer, reasonable redelivery and/or storage charges may apply.

11. Inspection, Damage & Defects

Customers should inspect the goods as soon as reasonably possible following delivery.

Where goods appear damaged, incorrect or incomplete, please notify The Oriel Studio as soon as possible and, where reasonably possible, within 48 hours, providing photographs/Videos and the relevant order number.

Prompt notification assists us in investigating transport-related damage.

12. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation;
  • Breach of statutory consumer rights;
  • Any other liability that cannot lawfully be excluded.

Subject to applicable law, we are not responsible for losses resulting from circumstances outside our reasonable control or losses that were not reasonably foreseeable when the contract was entered into.

Where you are purchasing as a consumer, nothing in these Terms restricts the remedies available to you under applicable consumer law.

13. Force Majeure

We will not be responsible for delays or failure to perform our obligations where caused by circumstances beyond our reasonable control, including:

  • Supply chain disruption;
  • Labour shortages;
  • Industrial action;
  • Transport disruption;
  • Government restrictions;
  • Severe weather;
  • Natural disasters.

Where such circumstances occur, we will take reasonable steps to minimise their effect and keep affected customers informed.

14. Intellectual Property

All content on this website — including text, images, product designs, technical drawings, architectural renders, and branding — is the property of The Oriel Studio or its licensors.

Unauthorised copying, reproduction, distribution, scraping, or commercial use is strictly prohibited and may result in legal action.

15. Website Use

You must not:

  • Use the website unlawfully;
  • Introduce malicious code;
  • Attempt unauthorised access;
  • Interfere with website functionality;
  • Use the website in a manner that infringes our intellectual property rights or the rights of others.

We reserve the right to restrict website access where reasonably necessary to protect our website, customers or business.

These Terms are governed by and construed in accordance with the laws of England and Wales.
